The Tenancy Agreement
The tenancy gives the Tenants the right to occupy the property for a holiday within the meaning of paragraph 8 or schedule 4 to the Housing (Scotland) Act 1998. Properties are let for a maximum of 4 weeks. Lettings commence at 4pm on the first day of the tenancy and end at 10am on the departure date unless otherwise agreed. The tenancy period cannot be extended without Isle of Mull Cottages’ permission. Tenants will be liable for any cost whatsoever incurred as a result of an unauthorised extension.
Payments
A deposit, payable at the time of the booking is entirely non-refundable. The remaining balance of the booking fee is refundable up until two months prior to the commencement of the period of hire. If the full balance of rent is not received by the due date, Isle of Mull Cottages is entitled to cancel the booking with immediate effect. If we do receive a cancellation and are able to re-let the property for the same period, we will refund any monies paid.
Cancellations - Isle of Mull Cottages does not operate a holiday insurance scheme. The Tenant is therefore advised to purchase suitable holiday cancellation protection cover. Any charges imposed on Isle of Mull Cottages by their bank for handling dishonoured cheques will be passed on to the hirer who is liable to reimburse Isle of Mull Cottages in respect of these charges within seven days of notification from Isle of Mull Cottages.
Premises – The Tenant’s Obligations
The hired premises shall be used solely for holiday purposes and not exceeding the total number of people as stipulated in the description of the property, and not to transfer possession of the property during the rental period.
The Tenant accepts the accommodation as it is equipped at the commencement of the letting period and shall at all times keep the rented premises clean and tidy. The Tenant will respect and treat the rented premises and its contents with care, and shall be responsible for any damage or loss to the rented premises or any of its contents, caused by the Tenant or a member of his or her party, during the rental period.
The Tenant shall allow the cottage managers entry to the rented premises for all reasonable purposes. To notify Isle of Mull Cottages prior to the commencement of the tenancy of any change to party numbers. Pets (where permitted) should not be left unattended in the property at any time.
Eligibility
Bookings must be made by a person over the age of 18 and will not be accepted without prior consent from Isle of Mull Cottages from groups of single persons under the age of 21.
Complaints
All complaints must first be referred to the property owner/caretaker during the tenancy to allow remedial action to be taken. It is essential that you contact the owner or their representative immediately if any problem arises so that it can be speedily resolved.
In no circumstances can compensation be made for complaints raised only after the tenancy has ended should the Tenant fail to advise the cottage managers during his or her tenancy.
Non-availability of property - Force Majeure
If for any reason beyond Isle of Mull Cottages’ control the property is unavailable on the day when the tenancy is due to begin (e.g. labour dispute, acts of terrorism, war, riot, civil commotion, malicious damage, compliance with a law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, insolvency or bankruptcy of an Owner, fire, flood, snow and storm etc.), or the property becomes unsuitable for holiday letting, we regret that neither we nor the Owner can, either jointly or individually, accept liability or pay any compensation. Tenants shall have no further claim against Isle of Mull Cottages.
Liability
No responsibility is accepted by Isle of Mull Cottages for any accident or mishap to persons while on the rented premises, or whilst engaged in any activity there from, or for any illness or injury arising from any cause whatsoever. Neither does Isle of Mull Cottages accept any liability for the loss or destruction of property belonging to the Tenant or any member of his or her party.
Isle of Mull Cottages will not be held responsible for any temporary or unexpected condition of the rented premises or its services (water, electricity) as a result of extreme weather conditions or other factors outwith its control.
Breach of Terms
If Tenants breach any of the above terms and conditions the cottage managers reserve the right to re-enter the property and terminate the tenancy, without prejudice to the other rights and remedies of Isle of Mull Cottages.
Data Protection Act
Information which is requested by Isle of Mull Cottages for the purposes of the booking will only be used by Isle of Mull Cottages for that purpose, for updating its records or for contacting Tenants for marketing purposes. Isle of Mull Cottages is entitled to pass the information to third parties where required to do so by law.
